📄 GENERAL TERMS AND CONDITIONS OF SALE
Short-Term Tourist Rentals
These General Terms and Conditions govern reservations made through the booking engine of the Sardinian Seaside Retreats website.
1. Contracting Parties
The tourist rental agreement is concluded between the Guest and the Property Owner of the selected accommodation.
Ana Paula De Oliveira Silva – Sardinian Seaside Retreats, VAT No. 03043670904, with registered office in Località Li Junchi snc – 07030 Badesi (SS), Italy, acts as duly appointed representative (mandatary with representation) of the Property Owner pursuant to Articles 1703 et seq. of the Italian Civil Code.
The Manager is authorized to promote the property, conclude rental agreements and collect payments in the name and on behalf of the Property Owner.
2. Nature of the Rental
The properties are rented exclusively for tourist purposes in accordance with Article 1, paragraph 2(c) of Law 431/1998 and Article 4 of Decree Law 50/2017 (Italian legislation on short-term rentals).
This activity does not constitute hotel or hospitality accommodation.
Hotel-type services such as 24-hour reception, catering, daily housekeeping, or linen change during the stay are not included unless expressly specified in the property description.
3. Booking and Payment
A reservation is considered confirmed upon payment of the total amount indicated at the time of booking.
Payments are processed through the booking engine.
All amounts are collected by the Manager in the name and on behalf of the Property Owner.
4. Rates and Cancellation Policy
Cancellation conditions are those specifically indicated in the rate selected by the Guest at the time of booking.
The specific terms of the selected rate (e.g., Standard or Non-Refundable) prevail over these General Terms.
In the event of no-show, the cancellation terms of the selected rate shall apply.
5. Check-in, Check-out and Legal Requirements
Check-in and check-out times are specified in the property description.
Guests are required to provide all personal information necessary to comply with Italian public security regulations.
Failure to provide mandatory information may result in refusal of access to the property without refund.
6. Maximum Occupancy
The number of guests must not exceed the maximum occupancy indicated in the reservation.
Any violation may result in immediate termination of the contract without refund and may give rise to a claim for damages.
7. House Rules
Guests agree to comply with the house rules communicated in the property description, the Guest Portal, or upon arrival.
Any conduct causing disturbance, damage, or improper use of the property is strictly prohibited.
8. Liability for Damages
Guests are responsible for any damage caused to the property, furnishings, or equipment during their stay.
The Property Owner reserves the right to claim compensation for verified damages, including after check-out.
9. Security Deposit
Where specified in the property description, a security deposit may be required.
If applicable, the deposit will be refunded after check-out, subject to verification of the property's condition and deduction of any damages.
10. Termination
In the event of serious breach of these Terms or violation of the house rules, the contract may be terminated with immediate effect and without refund.
11. Limitation of Liability
The Manager shall not be liable for damages resulting from circumstances beyond their control or from improper use of the property by the Guest.
12. Force Majeure
Neither party shall be held liable for failure to perform contractual obligations due to force majeure events beyond reasonable control.
13. Governing Law and Jurisdiction
This agreement is governed by Italian law.
Any dispute arising from or related to this agreement shall be subject to the exclusive jurisdiction of the Court of Sassari, Italy.
